Terms of Use of Yabrix Services

Master agreement for clients, agencies, and partners using our platform.

By creating an account, you agree to these terms. We’ve summarized the key obligations to help speed up your legal review.

These Terms of Service (“Terms”) govern your access to and use of Yabrix (“Yabrix”, “we”, “us”, or “our”), including our websites, applications, APIs, and related services (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of the Service

Yabrix provides a web-based analytics and productivity platform designed for website owners and organizations. The Service may include, depending on the selected plan:

  • Real-time web analytics and traffic measurement
  • Detection and classification of human traffic, crawlers, and automated systems
  • Privacy-focused analytics without the use of cookies or invasive tracking techniques
  • URL shortening with usage statistics
  • AI-assisted tools for analysis, content optimization, and insights
  • Tools for managing and publishing content across multiple platforms

The Service is provided on a subscription basis and may evolve over time.

2. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete information
  • Keep your account credentials secure
  • Be responsible for all activity under your account
  • You are responsible for configuring the Service in compliance with applicable privacy and consent requirements.

Yabrix is not responsible for unauthorized access resulting from your failure to safeguard your credentials.

3. Subscriptions, Trials, and Payments

  • All Yabrix services are provided exclusively on a paid subscription basis. Yabrix does not offer a free plan. Any trial period, if offered, is temporary and limited in scope.
  • At its sole discretion, Yabrix may offer a limited-time trial period. Continued use of the Service after the trial requires an active paid subscription.
  • Subscription fees, billing cycles, and included features are presented at the time of purchase.
  • Subscriptions are billed in advance for the selected billing period and remain active until the end of that period, even if canceled.
  • Cancellations take effect at the end of the current billing period. No refunds are issued for unused time or canceled subscriptions.
  • If you downgrade your subscription, the unused portion of the current billing period may be prorated and credited as a positive balance, at Yabrix’s discretion, to be applied to future renewals.
  • If you upgrade your subscription, the price difference will be prorated for the remainder of the current billing period.
  • Payments are processed through third-party payment providers (such as Stripe).
  • All fees are non-refundable except where required by applicable law.
  • You are responsible for all applicable taxes, duties, or levies imposed by any governmental authority.

4. Service Availability and Interruptions

  • Yabrix aims to provide a reliable and continuously available Service, but does not guarantee uninterrupted or error-free operation.
  • The Service may be temporarily unavailable due to maintenance, upgrades, system failures, network issues, or circumstances beyond Yabrix’s reasonable control.
  • Planned maintenance may result in temporary service interruptions. Where reasonably possible, Yabrix will provide advance notice.
  • Yabrix shall not be liable for any data loss, loss of revenue, loss of profits, or other damages arising from service interruptions or unavailability.
  • No refunds, credits, or compensation will be provided for service interruptions, outages, or performance degradation, except where required by applicable law.
  • You are responsible for maintaining your own backups of any data exported from the Service.

5. Data and Privacy

Yabrix is designed with a privacy-first approach.

By default, Yabrix provides analytics without the use of cookies or invasive tracking techniques.

Where required or explicitly enabled by the user through consent mechanisms, Yabrix may use cookies or a persistent user identifier (such as a user_uuid) to enable additional functionality, improve accuracy, or enhance the Service.

Any such processing is performed in accordance with applicable data protection laws and is described in our Privacy Policy, which forms an integral part of these Terms.

You are responsible for obtaining any legally required consent from end users for the use of cookies or similar technologies when using the Service.

6. Intellectual Property

All rights, title, and interest in the Service, including software, code, interfaces, designs, and documentation, are owned by Yabrix or its licensors.

You are granted a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.

7. Third-Party Services

The Service may integrate or interact with third-party services. Yabrix is not responsible for the content, availability, or practices of third-party services.

Your use of third-party services is subject to their respective terms.

8. Acceptable Use

You agree not to use the Service in any manner that could damage, disable, overburden, or impair Yabrix’s infrastructure or interfere with other users’ access to the Service.

In particular, you agree not to:

• Attempt to bypass usage limits, technical safeguards, or security mechanisms
• Use the Service for unlawful, abusive, or fraudulent purposes
• Introduce malicious code, automated attacks, or excessive traffic
• Resell, sublicense, or make the Service available to third parties without authorization
• Interfere with or disrupt the integrity or performance of the Service

Yabrix reserves the right to suspend or terminate access to the Service if these restrictions are violated.

9. Suspension and Termination

Yabrix may suspend or terminate your access to the Service at any time if:

  • You violate these Terms
  • You fail to pay applicable fees
  • Required by law or regulatory obligations

Upon termination, your right to use the Service will cease.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available”.

To the maximum extent permitted by law, Yabrix disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Liability, Service Availability and Data Accuracy

By using the Yabrix platform, you expressly understand and agree that the Services are provided on an “as is” and “as available” basis.

Yabrix does not guarantee that the Services will be uninterrupted, error-free, or available at all times. Temporary interruptions may occur due to maintenance, updates, technical issues, force majeure, or circumstances beyond Yabrix’s reasonable control.

Yabrix shall not be responsible for any business decisions, actions, or outcomes derived from the use of the data, analytics, reports, or insights provided by the Services. All analytics data is provided for informational purposes only and may be subject to delays, approximations, or inaccuracies.

To the maximum extent permitted by applicable law, Yabrix shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of profits, loss of revenue, loss of data, loss of goodwill, business interruption, or other intangible losses, even if Yabrix has been advised of the possibility of such damages.

In any event, Yabrix’s total aggregate liability arising out of or relating to these Terms or the Services, whether in contract, tort (including negligence), or otherwise, shall not exceed the total amount paid by you to Yabrix during the six (6) months preceding the event giving rise to the claim.

You acknowledge that the Services are not intended for mission-critical, life-critical, or safety-critical use cases, and you agree not to rely on the Services for such purposes.

The allocation of risk under these Terms reflects the fees paid for the Services and is an essential element of the agreement between you and Yabrix.

12. Data Processing Agreement (DPA)

Where the Customer uses the Service in a manner that involves the processing of personal data for which the Customer acts as data controller and Yabrix acts as data processor, the parties agree that the Data Processing Agreement (“DPA”) forms an integral part of these Terms.

By using the Service, the Customer agrees to the terms of the DPA.

13. Changes to the Service or Terms

Yabrix may modify the Service or these Terms at any time. Material changes will be communicated through the Service or by other reasonable means.

Continued use of the Service constitutes acceptance of the updated Terms.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or in connection with these Terms or the use of the Services shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain.
